Important information regarding the structure, scope, and regulatory posture of the 365 Surgical concierge program.

Non-Clinical Services
365 Surgical provides non-clinical concierge and care-coordination services. We do not practice medicine, provide medical advice, diagnose conditions, prescribe treatment, or make clinical decisions. All medical care is provided by licensed physicians and clinical professionals selected by the patient and/or the surgeon.

Relationship to Orthopedic Practices
365 Surgical operates as a contracted services provider to participating orthopedic practices. The concierge program is offered by the practice as part of its overall patient experience, and 365 Surgical serves as a turnkey provider delivering many of the non-clinical support services within that offering.
365 Surgical may collect program fees from patients on behalf of the practice, obtain required program agreements and consents, and remit funds to the practice on a monthly basis after deducting its contracted service fee.
No Patient Referral or Lead Generation
365 Surgical does not refer patients to surgeons or practices and does not operate as a lead-generation service. All patients offered the concierge program are existing patients of the surgeon or practice. The surgeon or practice introduces the program directly to the patient. 365 Surgical follows up only after receiving patient contact information securely from the practice.
Optional Program Participation
Participation in the concierge program is optional. Patients are never required to enroll in the concierge program in order to receive medical care, surgical services, or access to a surgeon or practice.
Communication, Escalation, and Emergencies
365 Surgical supports communication and coordination by routing non-clinical questions and logistical matters to the appropriate parties and by escalating clinical concerns to the surgeon or appropriate licensed provider according to established protocols.

Importantly, 365 Surgical communications and program materials clearly instruct patients that in the event of an emergency or urgent medical concern, they should contact their surgeon's practice, designated on-call provider, or emergency services directly, rather than contacting 365 Surgical. 365 Surgical is not an emergency service and does not act as a gateway or bottleneck to receiving medical care.

Alignment with Surgeon Protocols
All concierge services are delivered in alignment with the surgeon's protocols, preferences, and practice policies. 365 Surgical does not modify, override, or substitute for surgeon-directed care pathways and does not act as a barrier to care.

Durable Medical Equipment (DME)
365 Surgical provides logistical coordination for durable medical equipment and recovery-related items selected by the surgeon. The cost of such items is incorporated into the concierge program fee, and 365 Surgical pays the DME provider directly. The specific items included may vary by surgeon or practice based on clinical preference.

Specialty Support Resources
When appropriate, 365 Surgical may facilitate connections to physical therapy, nutrition, or mental health support resources that align with the surgeon's protocols and preferences. These services are provided by independent professionals and do not replace medical or psychiatric care.

Membership Structure and Fees
The concierge program is offered as a one-time, fixed-fee service covering a defined period of support (typically one year). The program is not structured as a recurring or retainer-based model. This distinction is intentional and is designed to comply with insurance contract requirements that may restrict retainer-based concierge arrangements.

Privacy, HIPAA, and Data Security
All 365 Surgical employees receive HIPAA training and the company has completed a HIPAA Security Risk Assessment (SRA). Patients enrolling in the concierge program sign an informed consent authorizing certain communications, including unencrypted communication between the patient, the care team, and 365 Surgical when appropriate. Encrypted communication is used between 365 Surgical and the practice when the patient is not involved.

The concierge program does not guarantee medical outcomes, response times, access to care, or scheduling availability. Descriptions of services are illustrative and may vary by practice, surgeon, and patient needs.
